TERMS  + CONDITIONS

For the purposes of this Terms + Conditions:

Account means a unique account created for You to access our Service or parts of our Service.

Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to 1064239 BC Ltd DBA Beyond the Medium or Beyond-The-Medium or Beyond_The_Medium, domiciled in Canada.

Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.

Country refers to: British Columbia, Canada

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Personal Data is any information that relates to an identified or identifiable individual.

Service refers to the Website.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

Third-party Social Media Service refers to any website or any social network website through which a User can log in or create an account to use the Service.

Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).

Website refers to Beyond The Medium, accessible from HTTPS://beyond-the-medium.com

You or Client means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

The Client agrees that by participating in a Beyond The Medium event, workshop, course, series, or other gathering, in-person or online, they accept the terms of these Terms and Conditions, their act of accepting thereby shall confirm that they have read and understand these Terms and Conditions, and that they agree to all of its terms.

COVID-19-related details: Currently, the BC provincial government does not require proof of COVID-19 vaccination or masking for all in-person events, retreats, or other gatherings. Please note that mandates by the BC provincial government are subject to change, and this part of the website as well as attendees will be updated accordingly as we receive any updates from BC. Please note that Mimi is not inviting the Client to share opinions on the COVID-19 vaccination; thank you in advance for respecting this boundary.

General

The Client confirms that these rules, liability waiver, and indemnification provisions supersede any and all previous promises or agreements regarding the subject matter hereof and understand that this is the entire agreement between them and Beyond The Medium. The Client agrees that by participating in a Beyond The Medium event, workshop, course, series, retreat, or other gathering, they accept the terms of these Terms and Conditions, and that they agree to all of its terms.

The Company’s energy is dedicated to areas where it can make the most impact. The Company will not respond to emails or Instagram DMs for "quick questions" related to its knowledge and skills. This policy ensures full commitment to paying clients.

Learning any skill requires time and hard work. The Company cannot simplify or shorten the process based on personal preferences. What is taught is accessible to anyone who is dedicated and committed. Perfection is not required. Instead, the Company encourages the Client to discard their inner rulebook and craft unique values that reflect their core. The goal is for the Client to grow into themselves, even into a version that may be unfamiliar—one that is deeper and more surprising.

The Company’s work and intellectual property must not be taken, resold, appropriated, or used without prior consent and proper crediting.

The Company reserves the right to decline a Client if it is determined that the collaboration is not the right fit.

Missed appointments will not be rescheduled, credited, or refunded. Clients are responsible for checking their inbox (including spam) for confirmation emails upon booking, applicable to calls, meetings, courses, and any other commitments.


Refund Policy

All sales are final. There are NO refunds or credits given for any reason. Tickets are non-transferrable. Please note if there are COVID-19 restrictions that affect BC that prohibit the event from taking place, clients will be given a credit for when the event is rescheduled. For clients who are affected by COVID-19 restrictions that are beyond BC, there will be no accommodations granted.

Payment Plan Agreement

All sales are final. No refunds. By this contract, the Client agrees to pay for course content such as Words That Work or any other course, series, or educational Content rendered by 1064239 BC Ltd DBA Beyond The Medium, hereafter referred as the Company, by the agreed upon schedule as selected by the Client in exchange for the purchased Content.

By this agreement, both Client and Company acknowledge and consent that payment of the established designated amount as indicated in the checkbox when purchasing the Content will be rendered to the Company upon enrolment in the Content, continue in the selected frequency on the website’s enrolment page, and until the total of the payment required has been delivered.

If, under whatever circumstances the Client’s credit card changes, Client must contact the Company immediately with updated credit card details. This agreement is binding, and failure to meet its terms will allow the Company to take certain recourse.

Subscriptions Agreement

All sales are final. No refunds. The monthly or annual subscription fee selected by the Client on the Website shall be charged to their credit at the time of sign up. Monthly memberships auto-renew on the same day each month of the initial month of enrolment. Should a Client desires to adjust their monthly sliding scale membership tier, they can adjust it anytime, and the changes in pricing will apply the following billing cycle. Annual memberships renew on the anniversary sign up day each subsequent year. Should a client desires to switch their annual sliding scale membership tier, they can adjust it anytime, and the changes in the annual pricing will apply the following annual billing cycle. Clients can make changes to their subscriptions by emailing hello@beyond-the-medium.com.

Assumption of Risk

The Client assumes all risk while participating in the Activities, whether or not caused by negligence of Beyond The Medium, and any of its owners, directors, employees, representatives, agents, contractors, or volunteers (collectively, the "Released Parties").

Property and Activities

Workshops, retreats, and other events ("The Activities") will be held at various venues within British Columbia, Canada, or online, by 1064239 BC Ltd dba Beyond The Medium Spirit + Beauty ("Beyond The Medium").

The Client expressly and voluntarily assumes all risk while participating in the Activities or in any aspect of the Activities, whether or not caused by negligence of Beyond The Medium, and any of its owners, directors, employees, representatives, agents, contractors, or volunteers (collectively, the “Released Parties”). The Client understands that their use and enjoyment of the Property and the Activities involve inherent risks, both those described herein and other risks, that are serious and that may involve dangers regardless of the care taken by Beyond The Medium or the Released Parties. The Client realizes their use and enjoyment of the Property and participation in the Activities require some degree of skill, coordination, and physical fitness. For Retreats or events involving movement, breathwork, nature walks or other activities, the Client understands the demands to be placed upon them relative to their physical condition and skill level, and appreciates the types of injuries that can occur as a result of such activities. The Client hereby asserts that their participation in the use and enjoyment of the Property and the Activities is voluntary and that they knowingly assume all inherent risks of the Property and the Activities, both those described herein and others presently unknown.

The Client understands that, in order to ensure that participants feel that their privacy during Activities is protected, and to ensure a full and open interchange of ideas among participants, they agree that they will not post writings on social media or blog about their fellow apprentices or their stories or experiences. The Client agrees to obtain prior written permission from Beyond The Medium before including content pertaining to any experiences therein in articles in magazines, books, video interviews, etc. Those who are attending an event, course, program, retreat, series, workshop, or other form of gathering, online or in-person, are permitted to post to personal social media pages regarding their personal experiences as educational storytelling, taking care to use quotes and tag appropriate parties and giving credit where credit is due is allowed and in fact can be quite valuable to the long-term sustainability of our endeavor. Posting to blogs of companies that the Client is affiliated with or employed by but not the owner, or including writing or photos from our program in magazines or blogs other than their personal page is prohibited. If the Client's personal and business account are merged, simply take care to not use our photos, quotes, or teachings for posts promoting their own goods or services. If in doubt about whether or not an intended post is honoring or appropriate, just ask! Beyond The Medium is always available for open dialogue concerning ethics of sharing.

Photography + Media

By entering the Activities, the Client, and all participants, agree to the following terms, conditions, and guidelines for the use of any imagery obtained during the Activities, including still photographs and videos (hereinafter “Beyond The Medium Imagery”). Beyond The Medium monitors dissemination of participant-related Imagery to ensure that Imagery is not used for any purpose other than “Personal Use,” and are not used for any other purpose, including without limitation, for advertising or commercial purposes. Participants may use Beyond The Medium Imagery only for “Personal Use,” defined to include: (1) sharing with friends and family; (2) displaying on personal websites (as long as the placement on the website does not in any way suggest these images in association with your own products or services, and does not purport or appear to be an official website of the apprenticeship) and (3) displaying on personal accounts, on photo sharing and social networking websites, such as Instagram and Facebook (as long as the display of the Beyond The Medium Imagery on these sites is not commercial or promotional in any manner and the account is not affiliated with any commercial enterprise. The Client understands and accepts that they may not make use of Beyond The Medium Imagery without prior written permission from Beyond The Medium other than personal use (as defined above). The Client understands that they have no right to sell, transfer, license, or sublicense their Beyond The Medium Imagery to any other party and agrees to inform anyone to whom they give any Beyond The Medium Imagery that it can only be used for Personal Use. The Client understands that they may not use or allow to be used any Beyond The Medium Imagery in any media article, newspaper article, video, blog, advertisement, or promotional materials, except with the prior written consent of Beyond The Medium. The Client understands that if they record Beyond The Medium Imagery with the intention to utilize it for non-personal use, they will be trespassing, and that trespassers have no rights to any use of Beyond The Medium Imagery, and Beyond The Medium reserves the right to take any necessary action against trespassers.

Model + Participant Release

Beyond The Medium does record certain events or programs, using authorized photographers. When the Client enters a Beyond The Medium event or program, they enter an area where photography, audio, and video recording by Beyond The Medium may occur. By entering the Property and attending the event, course, program, retreat, series, workshop, or other form of gathering, online or in-person, the Client hereby assigns to Beyond The Medium the irrevocable and unrestricted right to use and publish, display, exhibit, reproduce or use the recordings for commercial use which the Client may be included for editorial, trade, advertising, educational and any other purpose and in any manner or medium that Beyond The Medium designates and to alter the same without restriction. The Client releases all claim to profits that may arise from use of any images. The Client agrees to release Beyond The Medium, its officers, agents, representatives, and employees, and each and all persons involved, from any liability connected with Beyond The Medium’s taking, recording, digitizing, publication, and use of interviews, photographs, video and/or sound recordings at the Activities. By the Client's willing participation in an event, course, program, retreat, series, workshop, or other form of gathering, online or in-person, they consent to the recording of such gathering and the sale of the recording without compensation.

Alcohol and Drug Policy for All Events, Retreats + Gatherings

At all Beyond The Medium events, whether online or in-person, attendees are required to be sober throughout the duration of the event. We have a strict no alcohol and drug policy in place to ensure the safety, well-being, self and mutual accountability, and meaningful engagement of all participants.

This policy applies to all attendees, including participants, staff, and volunteers. Any violation of this policy may result in removal from the event without refund or credit.

We prioritize creating a supportive and focused environment for personal growth, learning, and connection. By adhering to this policy, we aim to foster a respectful and inclusive space for everyone involved.

Acknowledgements and Additional Agreements for In-Person Retreats

The Client acknowledges that they possess sufficient physical fitness and coordination to enable safe use and enjoyment of the Property and its Activities. The Client assumes the risk of all their medical conditions.

Medical Advice

The Activities essentially provide a space where persons can share ideas, information, and skills with others and learn and grow together. The Client understands that ALL activities are simply offerings, and they are under no obligation to partake in anything that they are not comfortable with for any reason. Furthermore, it is the Client's responsibility to check in with a qualified health care professional with any questions they may have about whether or not to participate in any of the activities, and to seek professional advice regarding participation in any herbalism based activities or culinary offerings. Beyond The Medium claims no responsibility or liability for any of the activities, and the Client hereby releases Beyond The Medium and all of the Released Parties for any discomfort, hardship, or injuries that they may sustain relating to any of the Activities or offerings.

Medical Waiver and Release

The Client assumes all responsibility for the decisions they make concerning their health care or in response to suggestions, recognizing that (a) no claims are made about herbal medicine, lifestyle changes, nutritional, dietary recommendations to treat or cure any medical condition, (b) there is no applied or stated guarantee of success or effectiveness of any specific plan or treatment, and (c) they are free to act on or disregard the recommendations of wellness or first aid personnel at the Activities. The Client consents to have medical clearance or treatment that may be deemed advisable in the event of injury, accident, and/or illness during the Activities, and authorizes Beyond The Medium, and its designated agents to administer emergency first aid, CPR, use any necessary medical devices, and secure emergency medical care or transportation if deemed necessary by Beyond The Medium or its designated agent, and agrees to be responsible for the payment for all costs of emergency medical care and transportation. The Client hereby releases Beyond The Medium, the Released Parties, and any and all persons participating in the provision of wellness, first aid, or any medical treatment to them at the Activities from any responsibility or liability relating to access to first aid, providing suggestions to them concerning first aid, for their decisions about what type of wellness, first aid, or medical aid to use, and for any emergency first aid that is provided to them.

Release and Waiver of Liability

The Client releases the Released Parties from any and all liability arising out of their participation in the Activities and use of the Property.

Indemnification

The Client agrees to hold harmless, defend, and indemnify the Released Parties from any claims made against Beyond The Medium or any of the Released Parties relating to any conduct by them during the Activities.

Force Majeure

Beyond The Medium is not liable for acts of God, weather, strikes, protests, or government actions that may interfere with the Activities.

Non-Negotiables When Enrolled in Any of Beyond The Medium’s Programs (Words That Work, or any other courses or events)

There are some essential parameters and codes of conduct that form the consensus to experience the program in a safe, inclusive, and effective environment suitable for learning. Individuals who cannot meet and respect these codes of conduct, and are unwilling to engage in accountability or feedback will be asked to leave the Program(s), and NO refunds NOR credit will be provided. They are:

  • Follow the first principle of harming none.

  • Follow the second principle of taking responsibility for your actions. This is critical as each of our energy has a profound impact on others.

  • Please leave your ego at the door. This includes spiritual ego. No exceptions.

  • No part of the content is to be shared/reposted as own, resold, plagiarized, or appropriated.

  • Any form of sexism, harm towards the LGBTQIA+ community, xenophobia/racism, fragility, or other forms of harmful intolerance, will not be endured and if exhibited, you will be asked to leave the coven and NO refunds will be provided.

  • No spiritual bypassing, including spiritual bypassing of racism or other forms of harm.

  • The Programs are not a ‘marketplace’ to promote your organization.

  • Show up to your gatherings and practices sober: At all Beyond The Medium gatherings and practices, whether online or in-person, attendees are required to be sober throughout the duration of the event. We have a strict no alcohol and drug policy in place to ensure the safety, well-being, self and mutual accountability, and meaningful engagement of all participants.

  • We each are responsible for holding respectful and on-topic space for the group. 

  • In these Programs, we do not gossip, speak of others behind their backs, spread rumours, scapegoat a member, or recruit others to your point of view at the expense of another member. 

  • Simultaneously, when a concern arises, we approach the situation with maturity, willingness, and curiosity to learn and then take ownership for our role in a dynamic.

  • Working communally invites different communication styles and perspectives, and in most cases, the different perspectives are from the unique intersections of family upbringing, race, culture, personality, faith, education, neuro-type and ability, and levels of privilege. This diversity doesn’t equate to, but can occasionally lead to conflict. We support each other in putting forth ideas / approaches freely and without personal attacks or other forms of hurtful behaviour. We also are committed to finding ways to hold complexity and nuance while maintaining consensus on respect and safety. 

  • Should the occasional conflict arise between members, the parties will mutually approach it with honesty, maturity, and kindness. Folks directly in the conflict will engage each other privately, and if the conflict cannot be resolved or neutralized, will ask for help and mediation from Mimi.

  • A complete and fruitful apology consists of embodied acknowledgement, verbally expressing what caused the harm, making the suitable amends, and reflecting on how to prevent a similar action from repeating.

  • My Programs are spaces to hold groups. If you need additional support outside of the allocated times, and beyond the scope, please book a private call with me.
